Recently, I received a call from someone concerned about a potentially lengthy estate administration process for a partner who is still alive and how to access funds after that partner passes away. This is a common worry for couples. This person was contemplating divorcing their partner while both were still alive to secure some assets and avoid the waiting period. However, this approach can lead to significant risks and complications.

For starters, we can’t predict who will pass away first. Additionally, a partner may not necessarily remain committed to the relationship after a divorce. The divorce process also brings about a range of changes in legal status and personal implications.

While divorce may be a reality for some people, considering it for the wrong reasons can have unintended consequences. I recall a story from my late brother, who was an attorney. He once had a client whose spouse received a substantial settlement from their divorce, only to ultimately walk away based on the misguided motivation of “protecting assets.”

Relationships play an important role in our daily lives, whether on a personal level or from a business point of view.
When you find yourself in a situation that feels out of alignment, taking small, daily steps can be an effective way to protect yourself and find the courage to advance to the next level.
Consider whether you are creating a toxic situation or simply on stage in another person’s play, contributing to the problem. Here are some signs to look out for:
– Micromanagement that doesn’t align with the situation.
– Superficial compliments when a favor is going to be asked.
– Insults exchanged in private conversations under the theme of, it is because I care for you.
– Public embarrassment.
– Financial control through manipulation.
– Backhanded compliments.
– Seeking emotional reactions, asking inappropriate questions, or making a statement you know will create an emotional response.
– Constantly changing the “agreed” targets.
– Mobbing.
– Taking credit for someone else’s ideas.
– Gossiping.
– False storytelling under the guise of “helping” you.
– Lies—more lies.
– Complimenting those above you while putting down those who are seen as lower on the food chain.
– Namedropping.
– Fear-driven tactics, defended by adding a name.
– Mind games.
– An unwelcome interest in your personal life.
– Everything feels staged and calculated.
– You’re reminded that equality among humanity is an illusion and that there is a clear hierarchy.
What did I miss? It is essential to protect your mind, your body, and your soul against toxic situations. Be careful, and seek guidance and professional help.

South African families often follow the trend of not discussing their family’s transfer of wealth before or even during critical changes. Each family has a unique story that impacts our world; we can accept matters as they are or choose a different outcome for ourselves and our families. Throughout the years, I have observed various family and estate planning scenarios. Some families have gone from having little to accumulating substantial wealth. In contrast, others have lost their wealth due to how some individuals perceive or mishandle money, leading to a new generation having to rebuild their wealth.

Families can initiate the discussion by discussing their family values, mission, and vision for the future. Suppose families miss specific opportunities or fail to plan for particular scenarios. In that case, they expose the family wealth story to risk factors, such as a claim that might be instituted and that could delay the administration process.

Families can take a few easy steps to start the process. Gathering information and finding an excellent professional will guide the family towards a better outcome.

May you be met by grace today, she might be a woman

During the COVID-19 pandemic, a woman drove into the back of my car on my way to school in South Africa, where we often encounter malfunctioning traffic lights. The impact was strong, and it caused tears in the backseat of my car. Initially, the woman didn’t stop, but she finally pulled over after convincing her.

I noticed we were both wearing masks, but I could see tears in her eyes. I asked her why she didn’t stop, and she explained that she didn’t see any damage to the car and was struggling financially due to the impact of COVID-19 on her livelihood as an artist. We ended up talking and connecting. She came to have supper at my house, and the incident inspired her to pursue other paths. It turned out that I knew her ex-husband. We both felt blessed by the grace we experienced on the day of the accident.

We never know how things will turn out or where we will make new connections. We always have a choice about how we wish to move forward, and nobody can take that away from us.
